Trump’s immigration plans face likely turbulence in courts

Federal courts have ruled repeatedly against President Donald Trump’s most audacious policies on immigration.

With Homeland Secretary Kirstjen Nielsen out of the way, and other DHS officials expected to be pushed out, White House senior adviser Stephen Miller hopes to accelerate or pursue more aggressive enforcement policies, including one regulation that allows children to be detained more than 20 days and another that would deny green cards to immigrants who’ve received public assistance or are deemed likely to do so.

Miller has also pressed to revive family separations at the border, though when asked Tuesday about this, the president said, “We are not looking to do that, no.”

But even if Trump “cleans house” — a phrase he’s never used, he told reporters Tuesday — he’ll still need to follow the law, and federal courts have ruled repeatedly against his most audacious policies on immigration.

“It’s just putting in someone who is willing to do it, but you’re still going to have the same obstacles,” said Lee Gelernt, an attorney with the American Civil Liberties Union who represents migrant parents in a major lawsuit over family separations.

In the most recent example, a San Francisco-based federal judge on Monday temporarily blocked Trump’s “remain in Mexico” initiative, which forces certain non-Mexican asylum seekers to wait in Mexico until the conclusion of their case in the U.S.

Most prominent was the “zero tolerance” border policy, which ran from April to June of last year. The policy called for all suspected border crossers — including parents and asylum seekers — to be referred for federal prosecution. As parents were placed the custody of the U.S. Marshals Service and taken to court, their children were labeled “unaccompanied” and handed over to the Health and Human Services Department.

Thousands of children were separated from parents during the three-month period, prompting broad outrage. San Diego-based U.S. District Judge Dana Sabraw eventually ordered children in custody to be reunited with their parents.

U.S. Citizenship and Immigration Services Director Francis Cissna, who current and former DHS officials suggested could be removed in the coming days, appears to have drawn Miller’s opposition by pursuing the Trump administration’s policy goals in a more legally rigorous fashion.

“His methodical approach is the approach you actually need to do to get lasting change,” a former DHS official said of Cissna.

Should the Trump administration, despite the president’s protestations, proceed with Miller’s latest iteration of family separation at the border, detained parents will be given two options: separate from their children or remain together in detention indefinitely.

ACLU’s Gelernt learned about the policy details only from media reports, but he argued that offering parents a “cruel choice” between leaving a child or staying with that child in detention would be ruled unlawful.

“It’s really not a choice for these parents,” he said.

Possible venues for legal challenges to family separations would likely pose a problem for the Trump administration.

In one scenario, the policy could become part of the ongoing lawsuit brought by the ACLU over family separations in San Diego. The case remains before Sabraw, an appointee of former President George W. Bush.

Alternatively, parties in the so-called Flores agreement — which currently limits the time children can spend in detention to 20 days and mandates other standards for detention — also could seek to strike down a new separation push.

Even Mark Krikorian, an immigration hard-liner and executive director of the restrictionist Center for Immigration Studies, contends the Trump administration again should seek to prosecute parents, but should keep parents from being separated from children.

“That’s what caused the problem,” he said.

Facebook is trying to put a stop to its most painful notifications.

The company is making several changes to how it deals with accounts that have been memorialized, including one that will attempt to put a stop to birthday reminders and event notifications for friends who have died.

Facebook has long been criticized for spammy notifications. But these can become much more than just a nuisance when one of your friends has died. With the newly announced changes, Facebook will try to prevent accounts that have been memorialized from showing up in notifications.

“Once an account is memorialized, we use AI to help keep the profile from showing up in places that might cause distress, like recommending that person be invited to events or sending a birthday reminder to their friends. We’re working to get better and faster at this,” Facebook COO Sheryl Sandberg wrote in a statement

It may sound like a rather obvious change (it is), but it’s one that could make things less painful for those who are grieving.

Additionally, the company is expanding the “tributes” section that’s available to profiles that have been memorialized. The tributes section will serve as a dedicated space for friends and relatives to leave messages on a loved one’s profile “while preserving the original timeline of their loved one,” according to Sandberg.

Facebook is also giving more control to legacy contacts — the individuals who are responsible for looking after a person’s Facebook account after it’s been memorialized. Legacy contacts will now be able to change additional settings, such as tags and who can view specific posts in the tributes section of a page.

A lack of communication is reportedly the latest sign of dysfunction within the Los Angeles Lakers organization.

Luke Walton and Magic [Johnson] haven’t spoken for weeks,” ESPN’s Ramona Shelburne said on The Jump on Tuesday, h/t NBA The Jump Fanpage. “That’s a problem.”

This comes after ESPN’s Adrian Wojnarowski reported last week that the Lakers are “an organization right now that is not aligned really on any level.”

Going weeks without communication between a team president and head coach is troubling for any organization, especially one that needs to focus on trying to figure out how to end a six-year playoff drought.

Friction between Johnson and Walton has reportedly lasted all season, thanks to the sky-high expectations that come with four-time NBA MVP LeBron James. Wojnarowski and ESPN colleague Dave McMenamin reported Johnson “admonished” Walton just weeks into the season amid a 3-5 start.

And while Los Angeles responded with a 15-6 run, injuries would soon derail the team’s season. Losing 10 out of an 11-game stretch in March officially put the nail in the coffin.

With a 37-44 record this season, Walton’s overall record sits at 98-147 with one game to play in Year 3.

Walton, who has one guaranteed year remaining on his contract, told The Athletic’s Bill Oram last month that he “fully expect[s] to be coaching this team again next year.” 

“I just view it as outside noise unless someone from within tells me that that happened,” Walton told Oram. “Unless someone from within our group is telling me that, I just view it like all the other things we’ve gone through as a team this year. Those are things that I don’t have the time to worry about. I’ve got more important things to do like getting the team better and doing my job.”

Of course, it may be tough for him to hear anything from the team if he isn’t on good speaking terms with the president. If that’s the case, a lack of communication could be worrisome.

Israel elections: Exit polls show frontrunners neck and neck

Ballot counting is under way in Israel, with early exit polls suggesting Benjamin Netanyahu‘s Likud party and Benny Gantz’s Blue and White party to be neck and neck.

Voting ended at 10pm (19:00 GMT) on Tuesday.

Two out of three exit polls, conducted by Israeli TV channels, showed Gantz’s party taking more seats than the conservative Likud, while a third poll showed the parties to be tied.

Both Netanyahu and his main rival Gantz claimed victory after polls closed.

“We won! The Israeli public has had its say!” Gantz’s Blue and White party said in a statement. 

But even as projected results showed that the leading parties had won a similar number of seats in the 120-seat parliament, with neither achieving a majority, two of the polls also predicted Netanyahu was in a stronger position to form a coalition government with the help of right-wing factions. The third poll suggested a dead heat.

“The rightist bloc led by Likud has won a clear victory,” Netanyahu said in a statement. “I will begin forming a right-wing government with our natural partner this very night.” 

If he wins, the 69-year-old will serve his fifth term in office, a record, and would become Israel’s longest-serving prime minister in the summer.

Official results are expected to be announced on Wednesday.

James Baker, the former top lawyer of the FBI, told lawmakers last fall that there were widespread concerns inside the FBI that President Donald Trump had attempted to obstruct the bureau’s investigation into his campaign’s links to Russians, according to a newly released transcript of Baker’s testimony.

Under questioning in 2018 from a Democratic committee lawyer, Baker described numerous officials who were distressed that the president may have obstructed justice when he fired FBI Director James Comey in May 2017. Baker said he had personal concerns and that they were shared by not just top FBI brass but within other divisions and at the Justice Department as well.

“The leadership of the FBI, so the acting director … The heads of the national security apparatus, the national security folks within the FBI, the people that were aware of the underlying investigation and who had been focused on it,” Baker said, running through a list of officials he said were worried that the president may have fired Comey to hinder the Russia investigation.

Baker said other FBI executives informed him that Justice Department officials raised concerns about obstruction by Trump as well.

His comments, some of which have been revealed in press reports in recent months, were included in a 152-page transcript of Baker’s testimony to the House Oversight and Judiciary Committees in October 2018, when Republicans led an investigation into the handling of the FBI’s Russia probe. The transcript was released Tuesday by the panel’s top Republican, Rep. Doug Collins (R-Ga.), who has been incrementally entering testimony from last year’s investigation into the congressional record.

Baker’s comments take on added significance in light of the impending release of special counsel Robert Mueller’s report. Mueller inherited the FBI’s Russia probe and the obstruction probe that began after Comey’s firing. In a four-page memo, Attorney General William Barr indicated that Mueller reached no traditional conclusion on the obstruction probe, prompting an outcry from congressional Democrats who demanded more details.

Barr said Tuesday he intends to release a redacted version of Mueller’s findings within a week.

In the transcript of his testimony, Baker added that he was briefed on conversations between former Deputy FBI Director Andrew McCabe — who assumed leadership of the FBI after Comey’s firing — and Deputy Attorney General Rod Rosenstein about whether Rosenstein could wear a wire to gather evidence in an obstruction probe. Though officials close to Rosenstein have called his suggestion a joke, Baker told lawmakers that he had a far different impression.

“This was not a joking sort of time. This was pretty dark,” Baker said.

Baker, who said he didn’t personally meet with Rosenstein but had been informed of his comments by McCabe, described an environment in which Rosenstein was upset that Trump had used his memo criticizing Comey’s leadership of the FBI as a pretense for firing him.

“In the context of those conversations at some point in time I thought it was — my understanding was it was the deputy attorney general who came up with the idea of wearing a wire into a conversation with the president and that my understanding from my conversations with at least with Andy and/or Lisa was that they took it as a serious statement, that it was a serious thing to think about,” Baker said.

Baker also recounted, from a discussion he was briefed on by McCabe, that Rosenstein told McCabe two members of Trump’s cabinet had endorsed the notion of invoking the 25th Amendment to remove Trump from office.

“[M]y understanding was that there was a conversation in which it was said, I believe by the [deputy Attorney General], that there were — that there were two members of the cabinet who were willing to go down this road already,” Baker told lawmakers.

Nokia 9 PureView review: 5 rear cameras doesn’t mean better photos

Tons of manual camera settings for advanced photographers • Runs clean Android One • No pre-installed bloatware

The Nokia 9 PureView has some promising ideas, but fails to execute on nearly all of them.

If you want an excellent smartphone camera, get an iPhone XS or iPhone XR, Google Pixel 3, Samsung Galaxy S10, or a Huawei P30 Pro. But whatever you do, don’t get the Nokia 9 PureView.

The Nokia 9 PureView’s five rear cameras, arranged in a hexagon that’s flush with the glass back, may be eye-catching, but the image quality and slow image processing will disappoint you over and over again.

It’s the same for the unreliable in-display fingerprint reader and middling battery life. The Nokia 9 PureView’s only redeeming quality is that it runs a clean, bloatware-free version of Android 9 Pie. But I don’t think that’s a good enough reason to spend $699 for the phone.

Before I get into the Nokia 9 PureView’s poor camera experience, I want to take a second to say I don’t completely dislike the phone. It has some good qualities.

The metal and glass design is really good and doesn’t feel cheap. The power button and volume rocker are in a reachable position unlike on the Galaxy S10. 

And even though the 5.99-inch OLED screen isn’t quite as edge-to-edge — there’s still “forehead” and “chin” bezels — as other phones, it’s bright, sharp, and colors look rich. The rounded display corners also keep it from looking dated.

I also like that the Nokia 9 PureView runs stock Android 9 Pie. This means no skins to slow down the software, no unwanted bloatware apps, and smooth performance. It’s really lovely.

The one feature I hate on the Nokia 9 PureView is its in-display fingerprint reader — it’s garbage. Like really terrible.

To be fair, most in-display fingerprint readers aren’t great — all of the ones I’ve ever tried are slower and not as responsive as physical sensors — but the Nokia 9 PureView has one of the worst I’ve ever used.

It always said my finger couldn’t be recognized, or I lifted my finger off it too quickly, or that I wasn’t pressing into the fingerprint icon hard enough.

Battery life is so, but could be better. The phone can last a full day, but if you’re looking for more stamina, there are tons of other phones with larger batteries.

You’d think with five rear cameras the Nokia 9 PureView would blow every other smartphone camera out of the water.

But alas, that’s not the case. While the phone is capable of capturing good photos, more often than not, it doesn’t. And when it does, you’ll need to put in the extra time during the edit process to transform a mediocre shot into a good one.

The Nokia 9 PureView’s camera problems are deeply rooted. Unlike other smartphones which capture one photo from a single rear camera, the Nokia 9 PureView takes one shot from each of its five 12-megapixel cameras (three “RGB” color and two monochrome sensors) and then stitches them together into a single super high-res picture.

Easy, right? Well, no, actually, it’s not.

You see, as powerful as smartphone processors are, the Qualcomm Snapdragon 845 chip powering the Nokia 9 PureView simply isn’t beefy enough to quickly composite five photos into one.

Whereas photos on smartphones like the iPhone XS or Pixel 3 or Galaxy S10 are immediately viewable in your camera roll after the shot’s taken, it can take many seconds for a photo to finish processing on the Nokia 9 PureView. I’ve seen photos take 10 seconds, 30 seconds, and even nearly a minute to process. It’s the kind of slowness I haven’t seen on a smartphone camera in years and nobody should have to wait for.

The slow image processing would be excusable if the photos were at least noticeably superior to those from other smartphone cameras, but they’re not.

In almost all shooting scenarios, the Nokia 9 PureView’s photos were decent compared to shots from the best smartphone cameras. They’re less vibrant, though.

You can see some minor differences when zoomed in, but who’s really pixel peeping if you’re posting photos to Instagram?

Here’s another shot to see how well the Nokia 9 PureView handles color accuracy. Compared to the Pixel 3 XL, the Nokia 9 PureView pulled out more shadow details.

This time, you can see there is a sharpness difference. Zoom in and you can make out the bricks on the buildings better on the Pixel 3 XL photo.

One very visible downside to the Nokia 9 PureView’s camera is that it tends to underexpose images. Shots like this former police department building look darker and duller as a result.

I took the Nokia 9 PureView out to lunch and dinner and in nearly every scenario, the camera makes food look less appetizing. I’ll eat the the taco on the right every time.

Portrait photos aren’t much better on the Nokia 9 PureView, either. While the camera is capable of collecting more depth information, which you can then adjust in Google Photos, the devil is in the details. This shot of our photographer Zlata shows how overcast shots are from the Nokia 9 PureView.

As for selfies…I’m not a fan. My skin looks pale and sickly compared to the same selfie taken on the iPhone XS.

Interestingly enough, the 20-megapixel selfie camera is able to pluck out more details than five on the back. Here, there’s actual dynamic range to my hair.

The Nokia 9 PureView also shoots photos in RAW and saves them as DNG files. Unlike JPEGs, RAW files contain more information and as a result can be used to recover “lost” details during the edit process.

I’m not disputing the value of RAW, but when it takes forever to process JPEGs, crunching RAW files on the underpowered Nokia 9 PureView isn’t exactly a walk in the park. Unless you’re really patient, you’re gonna grow old waiting for images to save.

And honestly, after spending hours comparing photos, I can’t say the Nokia 9 PureView’s RAW capture is worth it.

HMD Global, the company that owns the Nokia brand, tried its best with the Nokia 9 PureView.

The five cameras is an interesting idea and has a lot of promise. But the phone lacks polish. Image processing is unbearably slow and the in-display fingerprint sensor is unusable.

I don’t know if a faster processor like the newer Snapdragon 855 that’s powering new phones would’ve helped significantly speed up the image processing, but I do know I don’t want to see HMD Global abandon the five cameras. 

It’s a fresh idea that might just have been too ahead of its time. Unfortunately, it also means I can’t recommend this phone to anyone. Hopefully the next version will be better.
