Japan’s new Emperor Naruhito ascends Chrysanthemum Throne

Japan’s new Emperor Naruhito has formally ascended the Chrysanthemum Throne, a day after his father Akihito abdicated from the world’s oldest monarchy and ushered in a new imperial era.

Naruhito officially became emperor at the stroke of midnight local time (1500GMT Tuesday) but the process will be formalised on Wednesday with the 10-minute ritual, which is off-limits to female royals – even his wife Masako.

It took place on the first day of the new imperial era of Reiwa, meaning “beautiful harmony”, which will last throughout Naruhito’s reign.

The 59-year-old was presented with the sacred imperial treasures of a sword and a jewel, as well as the seal of state and his personal imperial seal, at a solemn ceremony in the Room of Pine in the Imperial Palace at 10:30am local time (01:30 GMT). 

Shortly afterwards, joined by Masako and other royals, Naruhito addressed the nation for the first time as its 126th emperor, as he vowed to stand with the Japanese people.

He swore to “act according to the Constitution… while always turning my thoughts to the people and standing with them”.

Naruhito also said he would “reflect deeply on the course” taken by his popular father who was seen as having brought the world’s oldest monarchy closer to the people, especially during natural disasters.

“When I think about the important responsibility I have assumed, I am filled with a sense of solemnity,” said Naruhito.

The pomp and ceremony will wait until October 22 when he and Masako will appear in elaborate traditional robes for a ceremony in the palace before parading through the streets of the capital to be congratulated by a host of world leaders and royals.

Naruhito will greet his first foreign head of state as emperor later this month, when US President Donald Trump visits Japan to meet the new monarch.

The emperor under Japan’s constitution is a symbol without political power.

The Oxford-educated Naruhito faces the delicate balancing act of continuing his father’s legacy of bringing the monarchy closer to the people while upholding the centuries-old traditions of the Chrysanthemum Throne.

Like his popular father Akihito, he has warned of the need to remember World War II “correctly” without downplaying Japan’s early 20th-century militarism.

He has also spoken of the need to modernise the royal family, and vowed when he married Masako – who left behind a promising diplomatic career – to protect her “at any cost”. 

She has struggled however to adjust to palace life, including being subjected to enormous pressure to produce a male heir, and has suffered stress-induced “adjustment disorder” for much of their marriage.

The couple have one child, a 17-year-old daughter called Aiko, who cannot inherit the throne because she is female.

Akihito’s abdication, the first in 200 years, has resulted in an unprecedented 10-day public holiday for the famously hard-working Japanese, with many taking advantage of the break to travel.

But despite the holiday exodus, and steady driving rain on Tuesday night, crowds still gathered at Tokyo’s famous Shibuya crossing at the clock struck at midnight to welcome the Reiwa era.

“The emperor was a good person … He was the symbol of Japan,” said Rika Yamamoto, a 24-year-old company employee sheltering under an umbrella on the crossing.

“I hope the new emperor will carry on the kindness the old emperor had.”

Venezuelans rally as opposition leader Guaido calls for uprising

Hundreds of Venezuelans rallied on Tuesday after opposition leader Juan Guaido called for a “military uprising” in his strongest move to take down President Nicolas Maduro since declaring himself interim president earlier this year. 

Guaido, in a video posted on Twitter earlier on Tuesday, said he had started the “final phase” of his campaign to remove Maduro from power, calling on Venezuelans and the military to back him.

He was surrounded by individuals in military uniforms and opposition politician Leopoldo Lopez in Venezuela, who has been under house arrest since being found guilty of inciting violence during anti-government protests in 2014.

Guaido said he was at the Caracas airbase La Carlota and called for people to come out in support as well. 

“The time is now,” Guaido said. “We are going to achieve freedom and democracy in Venezuela,” he added, urging supporters to take to the streets.

Shortly after, a small group of armed troops, who had appeared to pledge their support to Guaido, briefly clashed with soldiers supporting Maduro. Protesters and security forces also clashed. Video from Reuters showed a National Guard vehicle running over some protesters. And residents in different areas of Caracas also reported hearing the gunshots in the streets. There were reports of dozens of injuries. 

But by Tuesday afternoon, most of the clashes had ended, with Maduro’s government saying they were in full control and had the support of the military. 

“What took place today is an act of hostility” Giuseppe Yoffreda, Venezuela’s Ambassador in Qatar said.

“They are trying to execute a coup as a desperate attempt that seeks to [distract] and hide a lack of leadership,” he added. 

Defense Minister Vladimir Padrino also called the move a “coup attempt”. 

Maduro did not appear in public but tweeted that he spoke to military commanders who had shown him “total loyalty”.

Rival rallies

In Caracas, Maduro’s supporters rallied, chanting slogans of support while some people were giving out posters of Maduro with the Venezuelan flag behind him. 

“Here we are in support of our President Nicolas Maduro, and in support of our beloved homeland … this is a glorious town and our inheritance is freedom,” Areli Rodriguez, 63, a Venezuelan lawyer said from outside the Miraflores Palace, the presidential office.

Other supporters said they went out to support the revolutionary process.

“The opposition in Venezuela is fascist, they do not have the streets, they do not have support and that’s why their only alternative is violence, coups,” Gabriel Rodriguez, a singer and government supporter in Miraflores said.

Hundreds of opposition supporters also responded to Guaido’s call and went out to La Carlota, and other neighbourhoods in Caracas.

“I went out because we need to support the opposition to stop the usurpation of power,” Tony Pompa, an opposition supporter told Al Jazeera. 

“I believe that by going out to the streets we will show to the world that we are here, and we want an end to this dictatorship,” he said.

Meanwhile, Guaido also reiterated his calls for “the largest march in Venezuela’s history” on Wednesday.

Venezuela is immersed in a deep economic crisis. Hyperinflation, unemployment and food and medicine shortages have prompted more than three million Venezuelans to leave the country in recent years.

Guaido in January invoked the constitution to declare himself interim president, arguing that Maduro’s re-election in 2018 was illegitimate.

The United States and 50 other mostly Western countries have recognised Guaido while Russia, China, Turkey and Cuba back Maduro. 

On Tuesday, US Vice President Mike Pence reiterated the Trump Administration’s support for Guaido in a tweet, saying “We are with you!”

Senior US officials also declared their full support, with Senator Marco Rubio urging Venezuelans to take to the streets.

US National Security Advisor John Bolton called on the three senior aides to Maduro, who Bolton said had been working with the opposition, to make good on their commitment.

“It’s still very important for three figures in the Maduro regime who have been talking to the opposition over these last three months to make good on their commitment to achieve the peaceful transition of power from the Maduro clique to interim president Juan Guaido,” Bolton told reporters.

Meanwhile, Russia accused the opposition of using violence in what it said was a clear attempt to draw the country’s armed forces into clashes. 

“Instead of peacefully settling political differences, they have taken a course designed to whip up conflict, and provoke breaches of public order and clashes involving the armed forces,” the Russian foreign ministry said.

Turkish President Recep Tayyip Erdogan condemned the move and said Venezuela’s democracy must be respected. 

What’s next?

Although Guaido’s move on Tuesday took many by surprise, some analysts believe his action could change the course of events.

“This could lead to a different kind of dialogue,” Carlos Pina, a Venezuelan political analyst told Al Jazeera.

“It will be hard for [Maduro’s government] to sit at a negotiating table, but perhaps a larger part of the other political actors involved might be more interested in a negotiated solution, rather than a civil confrontation.” 

“Something is clear, and that is that even if the government survives this attempt, it will not be able to maintain the same strategy that it has carried out so far towards Guaido and his followers. This will definitely change,” he added. 

But others believe Guaido may have acted too soon without the needed public support.

“Even though the opposition went out and did everything possible, it doesn’t have enough popular support,” said Javier Buenrostro, a professor at the National Autonomous University of Mexico.

“The support it has doesn’t match the size of the action. The reaction does not make the government shake,” he told Al Jazeera.

Buenrostro said Guaido and Lopez had failed the US.

“Guaido has been telling the US he will manage to gather the needed military support, and five months later he has not achieved this yet, and despite the unconformities within the forces, the majority remains loyal,” Buenrostro said.

Congressional Democrats notch win in emoluments suit against Trump

Democratic lawmakers scored another victory Tuesday in their lawsuit accusing President Donald Trump of violating the Constitution by doing business with foreign governments.

U.S. District Court Judge Emmet Sullivan rejected the Justice Department’s argument that the term “emolument” in the Constitution should be read narrowly to apply to payments that amounted to bribes for official presidential actions.

The decision to allow the suit to continue opens the door to possible efforts by the House members and senators to use the case to pry free information about Trump’s business dealings and how the Trump Organization implemented a self-imposed agreement to limit foreign business at Trump’s luxury hotel in Washington and elsewhere.

However, the Justice Department and Trump’s attorneys seem certain to fight that effort. When a similar stage neared in a parallel lawsuit filed by the District of Columbia and the State of Maryland, Trump’s lawyers went to a federal appeals court and successfully got the so-called discovery process put on hold.

Asked about the ruling, Justice Department spokeswoman Kelly Laco said government lawyers will keep up the fight against the lawsuit.

“As we argued, we believe this case should be dismissed, and we will continue to defend the President in court,” she said.

Sullivan’s 48-page opinion delves deeply into the arguments about how to interpret the so-called foreign emoluments clause and concludes that it prohibits all payments and benefits from foreign governments, not just extra money foreign officials might try to pay to a president on account of his office.

“The Court is persuaded that the text and structure of the Clause, together with the other uses of the term in the Constitution, support plaintiffs’ definition of “Emolument” rather than that of the President,” wrote Sullivan, an appointee of President Bill Clinton.

“In view of the overwhelming evidence pointing to over two hundred years of understanding the scope of the Clause to be broad to achieve its purpose of guarding against even the possibility of ‘corruption and foreign influence’ … the Court is persuaded that adopting plaintiffs’ broad definition of ‘Emolument’ ensures that the Clause fulfills this purpose,” the judge added.

The Democratic lawmakers who launched the legal battle said they were elated at the ruling.

“This decision is a tremendous victory and vindication of a common sense reading of the Constitution. In an extraordinarily well-reasoned opinion, the court soundly rejected the President’s absurd argument that he is above the law. The next step should be discovery and full disclosure of all the documents and evidence relevant to our emoluments claims,” said Rep. Jerry Nadler (D-N.Y.), chairman of the House Judiciary Committee.

“The ruling is an important milestone in seeking to hold the President accountable for his ongoing violations of the Foreign Emoluments Clause of the Constitution,” Nadler continued.

“The Framers made it clear that government officials from the President on down were not to accept any benefits from foreign governments without first obtaining the consent of Congress. The Framers didn’t want the President to be influenced by foreign powers like Spain, England, and France in the 1780s or Russia or Saudi Arabia today. I am gratified that today the court agreed with me, Senator [Richard] Blumenthal and 199 members of Congress who brought this case, that the President’s loyalty to the United States must be complete and undivided. While much work remains to be done, today’s ruling is a victory for the Constitution — and a rejection of the President’s arguments.”

Sullivan reached no conclusion on the facts about whether Trump is actually violating the clause. He said those issues would wait for a later phase of the case, but the judge did rule Tuesday that he has power to order an injunction against the president if a violation is found.

Sullivan’s decision largely tracks with a decision a Maryland-based judge issued on similar issues last July.

However, three 4th Circuit judges who took up the case last month sounded deeply hostile to it, so an opinion is expected soon that could stymie that litigation.

Last September, Sullivan issued a separate ruling finding that the lawmakers had legal standing to continue with the suit.

There is no immediate threat to Trump of discovery beginning in the lawmakers’ suit because Sullivan ordered additional briefing in the coming weeks on whether he should certify both his rulings for immediate appeal to the D.C. Circuit.

In the time since the slow-moving suit was filed in 2017, Democrats have taken control of the House and now have subpoena power, which offers them another mechanism for obtaining information about Trump’s business with foreign entities.

But Trump is mounting an aggressive legal campaign against those efforts by filing two lawsuits in recent days aimed at blocking an accounting firm and two banks from complying with House subpoenas.

Reaching the playoffs for the first time since the 2014-15 campaign may pay dividends for the Brooklyn Nets, as they will reportedly be in play for some of the NBA’s marquee free agents this coming offseason.

On Tuesday, Anthony Puccio of SNY cited sources who said Kevin Durant, Kawhi Leonard and Tobias Harris are among players who “will at least consider” signing with the Nets.

“Making the playoffs definitely helped their chances,” one source said.

Puccio pointed to a number of connections the Nets have with some of the free-agents-to-be, including one between Caris LeVert and Durant. They are close friends who trained together in 2017, and Durant is potentially interested in playing with the swingman.

Prior to taking over as general manager of the Nets, Sean Marks was an assistant coach with the San Antonio Spurs, where he spent a few years alongside Leonard. He also has “solid rapport” with Leonard’s uncle, according to Puccio. In addition, Nets assistant coach Tiago Splitter played with Leonard, assistant general manager Trajan Langdon was a scout for the Spurs, assistant coach Bret Brielmaier worked with the Spurs and assistant coach Chris Fleming was San Antonio’s summer-league coach in 2014.

Meanwhile, Nets head coach Kenny Atkinson’s brother coached Harris’ youngest brother, per Puccio. Kyrie Irving also grew up as a Nets fan and might be interested in signing with Brooklyn.

Marks has high hopes for his ability to lure a top free agent, per Puccio: 

“The process we went through this year—and there’s a lot of positives that’ve come out of this year—can only help. It’s going to attract free agents. People are going to want to play here. They’re going to want to play for Kenny [Atkinson], they’re going to want to play in Brooklyn, they’re going to play for this ownership group. We have a lot of things going for us.”

Puccio explained Brooklyn can sign two max free agents if it trades Allen Crabbe and renounces D’Angelo Russell and its other impending free agents.

Russell was a major reason the team reached the playoffs this season. The first-time All-Star averaged a career-best 21.1 points and 7.0 assists as the team’s go-to player.

The 23-year-old is also a part of Brooklyn’s enticing young core, although the opportunity to sign someone like Durant or Leonard could cause the team to change directions.

Although the Nets haven’t won a playoff series since the 2013-14 campaign, they are well-positioned to become a contender in the Eastern Conference as soon as this upcoming season.

Mueller complained to Barr about report summary

Special counsel Robert Mueller wrote a letter to Attorney General William Barr last month complaining that a four-page memo Barr wrote characterizing Mueller’s findings “did not fully capture the context, nature, and substance” of the special counsel’s probe, a senior Justice Department official confirmed to POLITICO.

Mueller sent the letter to Barr on March 27, three days after Barr issued his four-page summary, and cited “public confusion about critical aspects of the results of our investigation.” The letter was first reported by The Washington Post.

“This threatens to undermine a central purpose for which the Department appointed the Special Counsel: to assure full public confidence in the outcome of the investigations,” Mueller wrote. A spokesman for the special counsel’s office, Peter Carr, declined to comment.

The letter will likely buoy congressional Democrats’ accusations that Barr mischaracterized Mueller’s report on purpose in order to protect the president. Its disclosure comes on the eve of Barr’s public testimony before the Senate Judiciary Committee, and amid a back-and-forth between the Justice Department and the House Judiciary Committee over whether committee staff can question Barr separately on Thursday.

The letter also reveals a widening gulf between Barr and Mueller, who have been friends for decades, and is a sign that the special counsel’s team was angry with how Barr characterized the findings.

A Justice Department spokeswoman, Kerri Kupec, said in a statement that Barr called Mueller after receiving the letter to discuss it further.

“The Special Counsel emphasized that nothing in the Attorney General’s March 24 letter was inaccurate or misleading. But, he expressed frustration over the lack of context and the resulting media coverage regarding the Special Counsel’s obstruction analysis,” Kupec said. “They then discussed whether additional context from the report would be helpful and could be quickly released. However, the Attorney General ultimately determined that it would not be productive to release the report in piecemeal fashion.”

“The Attorney General and the Special Counsel agreed to get the full report out with necessary redactions as expeditiously as possible,” Kupec’s statement continued. “The next day, the Attorney General sent a letter to Congress reiterating that his March 24 letter was not intended to be a summary of the report, but instead only stated the Special Counsel’s principal conclusions, and volunteered to testify before both Senate and House Judiciary Committees on May 1st and 2nd.”

Sen. Amy Klobuchar (D-Minn.), a member of the Senate Judiciary Committee and a candidate for the Democratic presidential nomination, tweeted: “Barr will have to answer for this at our hearing. Updating my questions!”

Rep. Jerry Nadler (D-N.Y.), chairman of the House Judiciary Committee, released a statement expressing outrage over the reports and demanded a copy of the letter by 10 a.m. Wednesday.

“The Attorney General has expressed some reluctance to appear before the House Judiciary Committee this Thursday,” Nadler said. “These reports make it that much more important for him to appear and answer our questions. The Department of Justice has also been reluctant to confirm a date for Special Counsel Mueller to testify. Given this evening’s reports, I will press the Department to schedule that hearing without delay.”

Nadler has been working to secure testimony from Mueller but there has been little back-and-forth with Justice Department officials to get it on the schedule.

Barr said at a news conference earlier this month that he had “no objection” to Mueller‘s appearing before Congress to discuss his report. Carr declined comment when asked about the status of talks to have Mueller testify to House Judiciary by May 23.

Barr made no mention of Mueller‘s complaining to him in a letter or in a phone call about the March 24 letter or the response to it in his congressional testimony earlier this month.

“Reports have emerged recently, General, that members of the Special Counsel’s team are frustrated at some level with the limited information included in your March 24 letter,” Rep. Charlie Crist (D-Fla.) said at the April 10 hearing. “That it does not adequately or accurately, necessarily, portray the report’s findings. Do you know what they’re referencing with that?”

“No, I don’t,” Barr replied. “I think — I think — I suspect that they probably wanted, you know, more put out. But in my view, I was not interested in putting out summaries. … I think any summary regardless of who prepares it not only runs the risk of being underinclusive or overinclusive but also would trigger a lot of discussion and analysis that really should await everything coming out at once.”

A senior Justice Department official said on Tuesday that the mystified tone of Barr’s response to Crist was driven by the attorney general’s puzzlement at the letter Mueller and his team had sent objecting to Barr’s March 24 letter, not by surprise at the news reports about Mueller’s staff griping or Crist’s line of inquiry.

“The attorney general and [Chief of Staff Brian] Rabbitt — they were very surprised at the complaint and at the frustration,” said the official, who spoke on the condition of anonymity. “They were actually shocked that there was a problem. He was actually being dismissive. He was puzzled by the complaint.”

The official told POLITICO the phone call between Barr and Mueller on the issue was cordial, despite the attorney general’s difficulty fathoming the complaint. “They’ve been colleagues a long time and they dealt with it and that’s it,” the official said.

However, Mueller’s objection did contribute to Barr’s decision to send another letter to Congress on March 29 updating lawmakers on the review of the report and emphasizing that the March 24 letter was not intended as a “summary” of the report.

The official said Barr didn’t disclose Mueller’s letter or the conversation about it over the past month because he considered it internal communications between department officials. “Mueller works for Barr,” the official added.

James Schultz, a former associate counsel in the Trump White House, in an interview Tuesday came to Barr’s defense on the March 24 letter.

“He needed to say something or there’d be this constant drumbeat,” Schultz said. “He gave an accurate depiction of it, but the fact that special counsel Mueller felt there wasn’t enough context, that’s the risk you run by being responsive early on.”

Indeed, the criticism of Barr, including calls from some Democrats for his resignation, were met with incredulity in some legal circles.

“Barr step down? Are you fucking insane?” said Sol Wisenberg, a former deputy on Kenneth Starr’s independent counsel investigation into President Bill Clinton.

Mueller’s chief complaint in the letter appeared to center on Barr’s characterization of the special counsel’s probe into potential obstruction of justice by President Donald Trump, and Barr’s refusal to release the executive summaries included in Mueller’s report. Barr quoted from portions of Mueller’s report in the four-page memo, and noted that the special counsel did not make a decision one way or another on whether the president had obstructed justice.

Barr and Deputy Attorney General Rod Rosenstein, however, came to their own conclusion, finding that “the evidence developed during the Special Counsel’s investigation is not sufficient to establish that the President committed an obstruction-of-justice offense.”

Barr also held a news conference two hours before the final report was released to the public, announcing that Mueller had found “no collusion” between the Trump campaign and Russia, despite Mueller’s assertion in the report that he not examine the evidence through the lens of “collusion” since that is not a legal term.

Mueller and his team notably stayed away from Barr’s news conference when he rolled out the release of the special counsel’s findings flanked by Rosenstein and Ed O’Callaghan, the acting principal associate deputy attorney general, who had the most frequent supervisor interactions with the Russia investigators.

Rosenstein submitted his resignation on Monday and is set to leave the Justice Department on May 11. He joked about the Barr news conference in a speech last week.

“Last week, the big topic of discussion was, ‘What were you thinking when you stood behind Bill Barr at that press conference, with a deadpan expression?’” Rosenstein said. “The answer is I was thinking, ‘My job is to stand here with a deadpan expression.’”

“Can you imagine if I did anything other than stand there at the press conference?” he added. “Imagine the reaction and the commentary if I had smiled or grimaced.”

Asked for comment and whether he was aware of Mueller’s letter to Barr, Trump’s personal attorney Rudy Giuliani replied via text” “No.” He didn’t immediately respond to additional queries for clarification.

Four sources told Politico in early April that Mueller’s team was concerned with how the attorney general handled the rollout of the special counsel’s findings.

“Yeah, there was frustration with the summary and that there’s a hope that people have access to the actual underlying report,” a source familiar with conversations about the Barr letter said then. “I think it’s fair to say there was generalized frustration.”

One of those sources close to some of the Mueller prosecutors said in an interview after the report’s release last week that at least in the way of the redactions the special counsel’s team was satisfied.

“Ninety percent is in there, especially on the obstruction stuff,” the source said.
