Here’s why San Francisco’s vote to ban facial-recognition tech matters

San Francisco just voted to ban facial-recognition technology.

The city that has for many come to symbolize the power of tech, both in all its terror and glory, took an important step on Tuesday to rein in some of that power. The city’s Board of Supervisors voted 8 to 1 in a veto proof majority to approve a wide-ranging ordinance that broadly regulates surveillance technology and prohibits outright the local government’s use of facial-recognition tech for surveillance. 

While this ban has not yet technically become law — the ordinance goes back before the Supervisors on May 21 and then Mayor London Breed must sign it — its backers are confident that, having passed this first hurdle, the ordinance’s success is essentially assured. 

This is a big deal, and not just for San Francisco. Experts who spoke with Mashable explained that the passage of such a measure, even in a city painted in the popular consciousness with a broad progressive brush, means that other local and state governments aren’t far behind.

“I think a ban will send a very strong statement within the national conversation about the potential harms associated with [facial-recognition technology],” Sarita Yardi Schoenebeck, associate professor at the University of Michigan’s School of Information, explained over email. “It’s likely it would encourage other communities to slow down and carefully consider the role of FRT in their communities.” 

As San Francisco goes, so goes California. As California goes, so goes the nation. 

Scaling oppression

San Francisco’s ban on facial-recognition tech is not happening in a vacuum. While companies like Amazon sell Rekognition to the feds and pitch ICE, governments around the world have become enamored of the technology’s dark promise to track people “attending a protest, congregating outside a place of worship, or simply living their lives,” as the ACLU puts it. 

“It infringes on people’s privacy and it heavily discriminates against some groups of people.” 

We see this terrifying reality in the Xinjiang region of Western China, where the government has imprisoned over a million Uighurs in a surveillance-state hellscape. More broadly, a New York Times report from April exposes how the Chinese government is “using a vast, secret system of advanced facial recognition technology to track and control the Uighurs, a largely Muslim minority.”

The details are, frankly, horrifying. “The facial recognition technology,” continued the Times, “which is integrated into China’s rapidly expanding networks of surveillance cameras, looks exclusively for Uighurs based on their appearance and keeps records of their comings and goings for search and review.”

It is naive to believe that geography or national borders will limit the spread of such pernicious technology. Ecuador, which has installed a network of Chinese-made surveillance cameras around the entire county, is proof of that. And lest you think the Land of the Free is immune to such overreach, companies that provide facial-recognition technology, such as Palantir and Amazon, are based in the United States. 

On the ground in San Francisco

While the people of San Francisco at present needn’t personally fear a Chinese-style surveillance state, the use of facial-recognition tech by law enforcement does represent a demonstrable threat to civil liberties. 

Such technology has higher error rates for people of color and women, and, as the San Francisco-based Electronic Frontier Foundation makes clear, this has the effect of “[exacerbating] historical biases born of, and contributing to, over-policing in Black and Latinx neighborhoods.” 

Professor Schoenebeck agrees. “It can be hard to anticipate how technology will be used,” she wrote, “but in the case of FRT, we already know that it infringes on people’s privacy and it heavily discriminates against some groups of people.” 

So, how is this ban going to make things better? 

“The Stop Secret Surveillance Ordinance would require City Departments to acquire Board approval before using or acquiring spy tech, after notice to the public and an opportunity to be heard,” reads an EFF blog post detailing the effort. “If the Board approved a new surveillance technology, the Board would have to ensure the adequacy of privacy policies to protect the public.”

“Each time we adopt a new technology we need to think about the unintended consequences of its use.”

Nash Sheard, the EFF’s grassroots advocacy organizer, explained over email that this ordinance will help to restore trust and accountability in the city’s government and police. 

Specifically, city agencies will no longer be permitted to directly employ facial-recognition tech to target, track, or surveil its own citizens. And, if local officials decide to contract with a private company that uses the tech, that use will be subject to public oversight. 

“Technology has the ability to create better transparency and to help us through our decision making process,” the EFF’s Sheard observed over the phone, “but each time we adopt a new technology we need to think about the unintended consequences of its use.”

Adam Harvey, a facial-recognition expert and the artist behind CV Dazzle (among many other things), explained over email that regulation backed by law is our best bet at keeping the potential dangers of facial-recognition tech at bay. However, he cautioned that the effort needs to be guided by those who best understand the threat.

“[Ultimately] the solution is a legislative one,” he wrote, “but without technologists stepping in to voice their concerns, create provocations, or alternative technologies, the debate on face-recognition technologies will continue to be steered by lobbyists and undemocratic organizations with little to no regard for civil rights.”

San Francisco, a city teeming with technologists and activists, appears up to the task of setting the national agenda on regulating facial-recognition tech. We should all hope it succeeds.

On the eve of Game 1 of the Eastern Conference Finals against the Toronto RaptorsGiannis Antetokounmpo believes the Milwaukee Bucks need to get off to a hot start. 

Per ESPN’s Malika AndrewsAntetokounmpo used Milwaukee’s previous series against the Boston Celtics as a point of comparison for what the team needs to do differently.

“Against Boston, you can go down 1-0 and still be fine; but against Toronto, it’s hard to be in that spot when you lose the first game in your home,” he said. 

The Bucks were stunned in Game 1 of the conference semifinals against Boston 112-90, their worst loss of the season. Even though some analysts said the series was over, Milwaukee responded with four straight wins by an average of 16.3 points. 

The Raptors are coming off a hard-fought series win over the Philadelphia 76ers, capped off by Kawhi Leonard’s miracle game-winner at the buzzer in Game 7. 

Even though Toronto won’t have a lot of rest before the Eastern Conference Finals begin, the team has proved itself all season to be one of the NBA‘s best and hasn’t been fazed by adversity.

The Raptors have made it this far without defensive star OG Anunoby all postseason following an emergency appendectomy on April 11. 

Of course, the Bucks had to play their first eight playoff games without Malcolm Brogdon due to a plantar fascia tear in his right foot. 

Antetokounmpo’s confidence and sense of urgency will be essential if the Bucks want to reach the NBA Finals for the first time since 1973-74. 

Milwaukee will have a chance to prove it’s not going to have a letdown when the series begins Wednesday at 8:30 p.m. ET at Fiserv Forum.

House Intel probing Trump attorneys for possible obstruction

The House Intelligence Committee is investigating lawyers tied to Donald Trump over allegations that they “reviewed, shaped and edited” former presidential fixer Michael Cohen’s false testimony to Congress.

Chairman Adam Schiff (D-Calif.) asked four attorneys who have worked for the president or his family members to provide documents and sit for interviews related to the claims made by Cohen, Trump’s former longtime personal attorney who is serving a three-year federal prison sentence for financial crimes and lying to the Intelligence Committee in 2017 about the timing of negotiations surrounding the construction of a Trump Tower in Moscow.

The attorneys — Jay Sekulow, Alan Futerfas, Alan Garten and Abbe Lowell — rebuffed Schiff’s demand for documents, which was first sent on March 14 and obtained by POLITICO on Tuesday. The New York Times first revealed the letters.

“Instead of addressing important intelligence needs, the House Intelligence Committee appears to seek a truly needless dispute — this one with private attorneys — that would force them to violate privileges and ethical rules,” Sekulow’s attorney Patrick Strawbridge said in a statement on behalf of the four attorneys. “As committed defense lawyers, we will respect the constitution and defend the attorney-client privilege — one of the oldest and most sacred privileges in the law.”

Their lawyers told Schiff on April 5 that his request does not have a “proper legislative purpose,” and their clients would therefore refuse to submit to Schiff’s demands for documents and witness interviews.

Cohen testified before three congressional committees earlier this year, including two daylong closed-door appearances before the House Intelligence Committee. Sources familiar with his testimony said Cohen turned over documents showing his false 2017 testimony to the panel about the Trump Tower Moscow project was edited. Cohen told the House Oversight and Reform Committee that Sekulow changed Cohen’s testimony — a claim Sekulow has denied. Cohen pleaded guilty last year to giving false statements to Congress.

In a follow-up letter on May 3, Schiff said some of the attorneys’ clients “may have engaged in discussions about potential pardons in an effort to deter one or more witnesses from cooperating with authorized investigations.”

Additionally, special counsel Robert Mueller’s report on his investigation into Russian election interference said that Cohen had “almost daily” contact with Sekulow, who served as Trump’s personal attorney throughout the Mueller probe. The day before Cohen submitted his false testimony, according to Mueller, he and Sekulow had several phone conversations.

Mueller’s report also stated that Sekulow declined the opportunity to provide more information to investigators about his conversations with Cohen. Mueller’s investigators decided not to pursue the issue further.

Schiff said in a statement to POLITICO that it would be “negligent” for the committee not to investigate those issues.

“If any individual is allowed to lie to our committee or encourage others to do so, hide behind inapplicable privileges, or otherwise fail to provide anything less than full cooperation, other witnesses will be emboldened to similarly obstruct, both now and in the future,” Schiff added. “We must not allow that to happen.”

In his May 3 letter, Schiff threatened to issue subpoenas absent voluntary compliance.

Trump and individuals associated with him have rebuffed nearly all of House Democrats’ demands for documents and witness testimony as part of their investigations targeting the president, his White House, his presidential campaign and his business empire. Last week, the House Judiciary Committee voted to hold Attorney General William Barr in contempt of Congress for defying a subpoena for the unredacted Mueller report and all of its underlying evidence.

The Intelligence Committee isn’t the only Democrat-led panel working to corroborate allegations made by Cohen. The Oversight Committee issued subpoenas seeking Trump’s financial records after Cohen told lawmakers that Trump artificially inflated and deflated the values of his assets in order to benefit financially, including when he applied for a loan from Deutsche Bank to place a bid on the Buffalo Bills NFL team.

Trump has filed federal lawsuits in his personal capacity to block various subpoenas seeking his financial documents.

Anthony Davis Trade Rumors: Star Would ‘Certainly Consider’ Staying with Knicks

New Orleans Pelicans big man Anthony Davis figures to be one of the biggest trade targets on the market during the NBA‘s offseason, but potential suitors have to weigh the cost with the reality he could leave following the 2019-20 campaign if he opts out of his contract.

The New York Knicks may not have to worry about that if they trade for him.

According to Ian Begley of SNY, sources said the Kentucky product “would certainly consider re-signing with the Knicks if he felt he could be successful in New York.”

Begley’s piece provided a road map for the Knicks to pair Davis with two max-contract free agents. He noted they would need to sign the two free agents first and then send out approximately $21 million in salary to accommodate Davis’ $27 million contract for 2019 under league rules.

He suggested trading the team’s 2019 first-round pick, which has a 14 percent chance at being No. 1 overall, is the “easiest way to get there.” However, he also pointed out “there is no consensus among the Knicks as to whether they would include the 2019 No. 1 pick in a deal for Davis or any other star.”

That No. 1 pick figures to be Duke’s Zion Williamson, who is a generational talent and someone the Knicks or Pelicans could build around for years to come.

However, Davis is a proven commodity at the highest level as a six-time All-Star, three-time All-NBA selection and three-time All-Defensive selection. New York would go from the team with the worst record in the league at 17-65 to an immediate contender if it signed two max free agents, such as Kevin Durant and Kyrie Irving.

Under that scenario, there would be incentive to pair those players in a win-now window with Davis, even if Williamson could become a star down the line.

Trading Williamson would not be an easy decision, although Davis’ willingness to remain in New York long-term would certainly be a factor.

Sudan opposition urges independent probe into protester killings

Sudan‘s opposition alliance blamed the ruling military council for renewed deadly street violence, demanding an independent investigation into the attacks that complicated efforts to negotiate a handover to civilian power.

At least four people died and dozens were injured during protests in a square outside military headquarters late on Monday as the Transitional Military Council (TMC) and opposition Declaration of Freedom and Change Forces (DFCF) said they had reached a partial agreement for transition.

Monday’s victims included a military police officer and three demonstrators, state TV said. An opposition-linked doctors’ committee revised its death toll from six to four, citing a mix-up in counting the bodies of victims, the Reuters news agency reported.

Gunfire rang out in the capital into the night after paramilitary Rapid Support Forces (RSF) – whose head is deputy of the military council – had patrolled the streets using tear gas and guns to disrupt demonstrations.

“The bullets that were fired yesterday were Rapid Support Forces bullets and we hold the military council responsible for what happened yesterday,” Khalid Omar Youssef, a senior figure in the DFCF, told a news conference.

“While they claimed that a third party was the one who did so, eyewitnesses confirmed that the party was in armed forces vehicles and in armed forces uniforms, so the military council must reveal this party.”

Demonstrators continued to block roads and bridges on Tuesday.

Call for independent probe

Protest leaders demand an independent investigation into Monday’s incidents, a call that has not received a response from the TMC yet.

“Many people believe that it will be very unlikely for the military to sign off such an investigation,” Al Jazeera’s Mohammed Adow said from Khartoum.

“The military insists that the incidents were the work of, who they call, armed infiltrators who got access to the square. They say those are the ones who shot people. However, protest leaders deny this claim.”

Monday’s fatalities were the first in protests in several weeks after months of demonstrations that led to army’s overthrow of President Omar al-Bashir last month.

The opposition and TMC were meeting again on Tuesday to discuss two sticking points: the military-civilian balance of power in transitional bodies, and the timeframe for elections.

Talks would wrap up on Wednesday, DFCF’s Youssef said.

The United States backed the opposition alliance in pinning the blame for Monday’s chaos on the military for trying to remove roadblocks set up by protesters.

“The decision by security forces to escalate the use of force, including the unnecessary use of tear gas, led directly to the unacceptable violence later in the day that the TMC was unable to control,” said the US Embassy in Khartoum.

McConnell defends Burr amid Trump Jr. subpoena fallout

Senate Majority Leader Mitch McConnell backed Senate Intelligence Chairman Richard Burr on Tuesday, signaling that the embattled Republican chairman will be able to stay the course on his committee’s subpoena for Donald Trump Jr.

“None of us tell Chairman Burr how to run his committee,” McConnell told reporters on Tuesday. “I asked him to undertake this investigation with Russian collusion a couple of years ago. He’s indicated publicly that he believes they will find no collusion.”

Though the GOP leader did not directly address the furor over the subpoena for Trump Jr., his continuing support for the Intelligence Committee’s investigation will be welcomed by Burr and other Republicans on the panel.

Burr in particular has faced severe criticism from the White House and fellow GOP senators for subpoenaing Trump Jr. even after the special counsel’s report was completed, though he’s shown no signs of backing down.

President Donald Trump lashed out at Burr again on Tuesday.

“My son spent, I guess, over 20 hours testifying about something that Mueller said was 100 percent okay. And now they want him to testify again,” Trump told reporters. “It seems very unfair to me.”

Republicans are worried that Trump Jr. has no intention of complying with the subpoena and is eager to force a floor vote on the subpoena, which would amount to a high-stakes loyalty test on the Senate floor.

If Trump Jr. doesn’t comply, the full Senate can take him to court over his resistance to being interviewed by the committee or held in contempt.

There may be ways to avoid that, such as allowing written responses or coming to some other deal with Trump Jr. But if anything is in the works, Burr isn’t saying.

“I don’t talk about engagement with witnesses. At all. Never have. I don’t have any comment as it relates to the interview process period. On anything. I’m not addressing anything relative to witnesses,” he said in an interview. “We’re continuing to try and wrap up our investigation.”

Facebook is about to let us in on one of its darkest secrets: how many companies can track us outside of its service, thanks to its ad targeting tools.

Though it’s been well known within the tech and advertising industry, it’s not something the typical Facebook user has been given much visibility into. But that will soon change, thanks to the company’s upcoming “clear history” tool. 

The long-promised (and much delayed) feature will allow people to see which websites send your browsing activity to Facebook and remove that info from the company’s servers. It is expected to launch in the next few months, according to Facebook.

But there’s one group that may not be thrilled with the rollout: advertisers, who will have a more difficult time targeting Facebook users, once clear history becomes available, the company warned. 

“When someone disconnects their off-Facebook activity, we won’t use the data they clear for targeting,” Facebook wrote in a blog post intended for advertisers. “This means that targeting options powered by Facebook’s business tools, like the Facebook pixel, can’t be used to reach someone with ads. This includes Custom Audiences built from visitors to websites or apps.”

That may seem obvious — many advertisers have long assumed “clear history” would impact their ability to target people — but here Facebook is spelling out exactly what that means. Once someone clears their history, advertisers will no longer be able to use some of Facebook’s most powerful advertising tools. For a company that has long touted its ability to help businesses reach the right people, this will be a huge change that will almost certainly negatively affect advertisers (assuming Facebook makes the tool accessible enough that it’s adopted en masse).

Facebook, on its part,  seems well aware that this won’t be popular with advertisers, and repeatedly tried to position clear history as ultimately being “good for businesses.”

“We believe that offering people greater transparency and control will ultimately have a positive, long-term effect on businesses using Facebook,” the blog post says. In the short-term, however, things might get rocky.
