Bangladesh‘s former chief justice was forced to resign last November after the head of the country’s military intelligence agency threatened him at the behest of the government, according to a sensational new autobiography.

In the controversial book, “A Broken Dream: Rule of Law, Human Rights & Democracy”, Surendra Kumar Sinha says the Directorate General of Forces Intelligence (DGFI) told him to resign otherwise a businessman, held in DGFI’s secret custody for over two months, would suffer “serious consequences”.

The book details the background to his recent exit from Bangladesh and includes claims of government interference in judicial decision-making as well as false imprisonment.

Justice Sinha writes that he feared DGFI might not only “kill” the businessman Aniruddha Roy, someone he knew well, but also “members of my family”.

“I realised that it was nothing, but systematic and organised state terrorism … and their treatment was so cruel that it could be compared with none other than the Gestapo force of Hitler,” he writes in the book.

Dozens of people, including opposition activists, have been picked up and disappeared since the Awami League party led by Sheikh Hasina came to power in 2009.

The former chief justice, who now lives in Canada, told Al Jazeera that the DGFI was acting directly under the instructions of Prime Minister, Sheikh Hasina. “The DGFI chief clearly said to me, ‘Whatever I am telling you is the version of the prime minister. There is nothing between us.’”

He said that Hasina wanted him to resign after he refused her personal request in July 2017 to uphold a law, which sought to give parliament the power to sack judges.

The former chief justice claimed that the prime minister was “enraged” and “could not tolerate it” because she wanted the courts “to be used as instruments to serve the government’s purpose”.

He denied there was any basis to corruption allegations made against him which the government claim is the actual reason he left the country and resigned. It was only after I gave a judgment against the government that “they discovered I am corrupt”, he says.

“If the chief justice cannot get justice in Bangladesh, how can any other citizen get justice in the hands of this government,” he told Al Jazeera.

Based on ‘wild imaginations’

The prime minister’s office and DGFI have failed to respond to the allegations despite repeated attempts by Al Jazeera to contact them via phone calls and e-mails.

The country’s top legal officer, however, told Al Jazeera that the book was not “based on facts”.

“Justice SK Sinha has written the book basing on his wild imagination, not on facts. There is no need to take this book seriously,” Mahbubey Alam, the Attorney General, told Al Jazeera.

“The country’s judiciary is in an excellent shape,” said Bangladesh’s top legal officer.

He denied pressing Justice Sinha to rule in favour of the government.

“The judiciary of Bangladesh works independently. There was no pressure on SK Sinha. It was his own misconduct that forced other judges to decide not to sit with him on the same bench. SK Sinha, however, didn’t say much about his own misconduct in the book, did he?”

Anisul Huq, the law minister, refused to speak on the issue, saying “You will get to know about it next week when I speak to the press.”

The conflict begins

Sinha was appointed Bangladesh’s chief justice in January 2015, becoming the first Hindu to take up the highest judicial post in the majority Muslim country.

He presided over the Supreme Court when it upheld the controversial executions of five leaders of the Islamist party, the Jamaat-e-Islami, convicted of international crimes committed in 1971 during the country’s independence war.

The conflict which led to justice Sinha’s forced retirement started in 2016 when the government became concerned about how the courts would respond to a legal challenge to a new law – the 16th amendment to the constitution. The new bill had given members of parliament the power to sack judges, taking the responsibility away from the judiciary.

In his memoir, A Broken Dream, justice Sinha wrote that he was told by one of three High Court judges ruling on the law’s constitutionality that a military intelligence DGFI officer had “met him in his chamber and pressured him to deliver the judgment in favour of the government”.

However, a majority of the judges ruled the law illegal and the government appealed to the appellate division presided by justice Sinha.

On October 1, 2017, the day before the appeal ruling was due, Sinha says he was invited to a late night meeting where the president, the law minister, the Attorney General and the prime minister Hasina repeatedly pressed him to rule “in favour of the government”.

“The prime minister appeared to me blind for retaining power and her only object was how to control the Supreme Court for coming to power in the next election,” Sinha states in his book. “Her approach was unethical and unconstitutional.”

Speaking to Al Jazeera, the former chief justice said that, if the law was passed it would have meant that “judges would be scared that they would be removed” if they were to give rulings against the government or politicians.

On the following day justice Sinha “dismissed” the government’s appeal “unanimously”.

Vociferous criticism

The written copy of the judgment published one month later at the beginning of August 2017 triggered vociferous criticism from the government and its supporters.

Quamrul Islam, the food minister, demanded that the chief justice “step down within a month”, otherwise “lawyers would launch a vigorous movement next month to remove him”.

Islam accused Sinha of “siding with the anti-liberation forces”, referring to those who fought against Bangladesh during the independence war.

Government ministers and supporters also took exception to a comment in the judgment which stated that “No nation – no country is made of or by one person”, claiming that it was a negative reference to Sheikh Mujib, the father of the prime minister and the country’s independence leader, known by many as “the father of the nation”.

The prime minister said in parliament that “the chief justice has raised questions about the role of the father of the nation and the country’s independence”.

DGFI intimidation

According to Sinha’s book, a DGFI officer first contacted him in Japan last September telling him he “should not return to the country and I must go to Australia or Canada for the time being until they decided about my next course of action.”

Sinha refused and returned to Bangladesh.

On October 1, a senior judge told Sinha that the country’s president had met up with him and other judges and “disclosed to them some [corruption] allegations against me, which were serious, and the president directed them not to sit with me in court”.

Justice Sinha denied that there was any substance to the allegations. “What are the allegations? So long as I delivered judgments that went in the government’s favour I was a good person. It is only later after I gave the judgment against the government, that they discover I am corrupt,” he told Al Jazeera.

According to Sinha, the head of DGFI, Major General Mohammad Saiful Abedin met him the next day in his court chambers, and said that the judgment had made the opposition Bangladesh Nationalist Party happy.

“The BNP was so happy that they distributed sweets among themselves. They exchanged text messages that they were coming to power soon,” he wrote in the book. He told the chief justice that he should go on holiday for four months.

Khaleda Zia, the BNP leader, remains in jail after she was convicted in a corruption case in February. Opposition leaders say the opposition leader is a victim of political vendetta ahead of the parliamentary elections slated to be held the end of this year.

When justice Sinha returned to his house that day, the former chief justice says he found security had been beefed up around his house.

He told Al Jazeera, “I was kept under house arrest for 15 days. I was not allowed to speak to anyone. My officials were transferred, and everything was done under the direction of the DGFI.”

The end game

In mid-October, Sinha decided he had no option but to leave the country. He states in his book that in the early hours of November 10, 2017, while staying in Australia and about to travel to Canada, a DGFI officer, Colonel Md Nazimuddoulah came to his house and told him that the businessman Aniruddha Roy had been freed.

“He then told me that he was kept at an undisclosed location and if I resigned it could lead to Aniruddha’s release,” Sinha writes.

He says that he told the officer that he would not resign until he had spoken to his wife and was sure that Roy had been taken home.”

After a few minutes, they gave the phone to his wife. She was also wailing and making entreaties to me to tender my resignation in exchange for the life of her husband.” Sinha then spoke to Roy who said: “Sir, I am on the stairs of my house.”

The former chief justice says he then signed the resignation letter.

The present government is the biggest beneficiary of my “impartial pronouncements”, Sinha concludes in his book.

But he goes onto say that he was however “rewarded by being called a corrupt chief justice… and then they used the media to assassinate my character”.

“… I have been humiliated at the hands of DGFI who treated me as less than an ordinary citizen only because I did not allow the Supreme Court to become subservient to the government.”

The UN special envoy to Yemen has said that he is looking forward to “announcing the reopening of Sanaa airport next week” to commercial access two years after the devastating war forced its closure.

In an exclusive interview, Martin Griffiths told Al Jazeera late on Thursday he was also “working on resuming Yemen talks [between the warring sides] within weeks in Europe”.

UN-brokered talks between the Houthi rebels and exiled Yemeni government, which is militarily backed by Saudi Arabia and the UAE, was stalled earlier this month after the Shia rebels could not make it to the venue in the Swiss city of Geneva.

“I don’t think we can allow it to be delayed until over the horizon because the problem with that is that people lose the narrative of peace and once you lose the opportunity to talk about the settlement, the narrative of war becomes dominant,” he said. “That’s what we must try to get away from.”

He also said he wanted to make announcements “about how we can get prisoners released, [from] both sides”.

“We made a lot of progress since Geneva and I want to work with the central bank of Yemen and their counterparts in Sanaa on payment of salaries which is crucial, by the way, for the humanitarian issues,” he said.

The World Food Programme (WFP) said on Thursday there “very well could be” famine in remote areas of Yemen, underscoring the bleak humanitarian situation in the country.

The UN food agency has warned that Yemen, the poorest nation in the Middle East, is on the brink of a full-blown famine, with 18 million of its 29 million population food insecure.

Failed talks

At the Geneva peace talks aimed at ending the three-year war, only representatives of the exiled Yemeni government of Abd-Rabbu Mansour Hadi turned up, as the Houthis insisted their plane to Geneva be allowed to evacuate dozens of injured people to neighbouring Oman.

Al Jazeera’s Bernard Smith, reporting from neighbouring Djibouti, said the reopening of the Sanaa airport – the country’s main international airport – was one of UN’s priorities because of the need for evacuations.

“There are thousands and thousands of people who need life-saving medical treatment overseas. Yemen’s health ministry estimates that between 25- to 30,000 people a day are dying because they cannot leave the country via Sanaa airport,” he said.

Even as Griffiths pushes for peace talks, Yemen’s exiled government says it will not coooperate with the UN human rights mission, which has been investigating into suspected war crimes during more than three years of conflict.

It accused the UN of bias, saying the investigators have turned a blind eye to violations by Houthi rebels.

Last month, in a report the panel accused both government forces and Houthi rebels of violations but said that coalition air strikes had caused “most of the documented civilian casualties” and voiced “serious concerns about the targeting process”.

On Sunday, almost 1.8 million voters in former Yugoslav Macedonia will decide whether to change the country’s name to Northern Macedonia.

The proposal stems from an agreement last June with the Greek government aiming to normalise relations between the two countries.

Athens and Skopje have been at odds since the fall of Yugoslavia, when its six republics declared independence, the southernmost calling itself the Republic of Macedonia.

Greece objects on the grounds that this implies territorial claims on its northern region of Macedonia.

In return for adding the qualifier “Northern” to its name, Greece will lift its standing veto on its neighbour’s membership in the European Union and NATO.

The question put to voters is: “Are you in favour of NATO and EU membership, and accepting the name agreement between the Republic of Macedonia and Greece?” 

Polls will open at 7am (05:00GMT) and close at 7pm (17:00GMT).

1. Which way is the referendum likely to go?

Opinion polls show a large bloc of voters supports the Prespes Agreement – a survey on August 8 showed 41.5 percent in favour and 31.5 percent against the name change. An August 29 survey showed 57 percent in favour, and 38 percent against.

But the crucial question is how many will vote?

To be constitutionally valid, the referendum requires a majority of 50 percent plus one, from a turnout of 50 percent of eligible voters plus one.

The opposition VMRO-DPMNE party has increasingly encouraged people to boycott the vote rather than voting no as it does not put the party on the wrong side of history should the yes vote have the majority, and it is easier to persuade people to do something passive than something active.

A survey released this month suggests that this tactic may be working. By its reckoning, only 58 percent of voters will cast ballots on Sunday.

Even though that doesn’t invalidate the result, it reduces the yes vote to 40.9 percent – not enough to win, and below the 41.5 percent of yes voters polled in July.

2. What are the main arguments for and against?

The strongest argument for a yes vote is clearly that it removes Greece’s veto on the country’s path to European Union and NATO membership.

But those who favour joining the EU (83 percent) and NATO (77 percent) are roughly double the number polling in favour of the Prespes Agreement. 

Some object to the very fact of a referendum, pointing out that no other former Yugoslav republic had to undergo this process.

Others object to the qualifier “Northern”, saying that it changes their identity. According to the agreement, their passports will henceforth list their nationality as “Macedonian – citizen of the Republic of Northern Macedonia”.

When talks with Greece began in January, US special envoy Matthew Nimetz handed the two sides a list of five names: Republika Nova Makedonija (Republic of New Macedonia), Republika Gorna Makedonija (Republic of Upper Macedonia), Republika Severna Makedonija (Republic of Northern Macedonia), Republika Vardarska Makedonija (Republic of Vardarska Macedonia) and Republika Makedonija (Skopje). 

Greece was prepared to accept any of the first four. The government in Skopje selected “Northern” as the least objectionable.

Some voters also object to the stipulations of Article 7, whereby “the official language and other attributes of [former Yugoslav Macedonia] are not related to the ancient Hellenic civilisation, history, culture and heritage [of Greece]”.

This means that those who self-identify as ethnic Macedonians abjure all claim to Greece’s Hellenistic heritage – the empire of Alexander the Great and its aftermath – which is a component of the Greek sense of nationhood.

These cultural distinctions were included on Greece’s insistence, to sweeten the pill of sharing Macedonian identity with their Slav neighbours, something most Greeks still object to.

The want it made clear that non-Greek Macedonians are so named by virtue of shared geography, not ethnicity or heritage.

Despite the fact that the agreement officially only addresses the issue of the country’s name, it is the separate issue of identity that could sink it.

This is underscored by the fact that ethnic Albanians, who comprise one-third of the population of former Yugoslav Macedonia, support the agreement to the tune of 88 percent.

Unaffected by the identity issue, they simply want the country to press ahead with EU and NATO membership.

3. What are NATO and the EU saying?

They are strongly encouraging the yes vote.

“I sense a real political will to move on with your country’s Euro-Atlantic integration,” said European Council President Donald Tusk when he visited Skopje in April.

The Sofia Declaration, which the EU signed in May, lends “unequivocal support for the European perspective of the Western Balkans”.

NATO Secretary-General Jens Stoltenberg, in a joint statement with Tusk after the Prespes Agreement was signed, said: “We hope this unique opportunity to re-launch the wider W. Balkan region’s European and Euro-Atlantic integration will not be wasted. This agreement sets an example to others on how to consolidate peace and stability across the region.”

German Chancellor Angela Merkel, US Defence Secretary General James Mattis, NATO’s Stoltenberg and Austrian Chancellor Sebastian Kurtz, who currently holds the EU’s rotating presidency, all visited Skopje this month to support the yes vote.

4. Why is this referendum important to the EU and NATO?

European Union enlargement stalled after the addition of Croatia in 2013, and was reversed with the departure of Britain in 2016. The Western Balkans have languished in a slow accession process for over a decade.

NATO enlargement has remained alive with the accession of Montenegro last year, but it has faced Russian military incursions in larger aspiring members Georgia (2008) and Ukraine (2014). These have appeared to define the alliance’s limits, and the limits of American hegemony. 

Both institutions appear to want to keep alive the momentum of expansion and integration as a way of reaffirming the Euro-Atlantic post-war order.

5. Yugoslavia fell apart in 1991. Why is the issue being decided now?

Athens and Skopje failed to find a solution in the 1990s because Greece did not want to accept a name that included the term Macedonia.

In 1995, after four years of failed diplomacy, the two sides settled for an Interim Accord whereby Greece recognised its northern neighbour as the Former Yugoslav Republic of Macedonia (FYROM).

In the mid-2000s, the Greeks signalled their willingness to compromise on a composite name that included the word Macedonia, but the nationalist government of the VMRO-DPMNE under premier Nikola Gruevski in Skopje ruled this out.

It went a step further than its predecessors and laid claim to ancient Macedonian heritage in addition to the Macedonian name, putting up giant bronze statues of Alexander the Great and his father Philip in the capital.

The Gruevski government fell from power in December 2016, and Zoran Zaev’s Social Democrats formed a government on May 31, 2017. They immediately sent foreign minister Nikola Dimitrov to Athens, to signal readiness to re-open talks with Greece.

6. If former Yugoslav Macedonia says yes, will Greece ratify the deal?

Greece is contractually obliged to ratify the agreement if its neighbour ratifies it and passes a number of constitutional amendments in parliament.

7. If there is a no vote, what will happen?

The Zaev government has suggested that it may try to ratify the agreement in parliament. It holds a majority of 68 in the 120-seat chamber, so it would need to attract 12 votes from the opposition to form a two-thirds majority.

Alternatively, it could declare a general election to increase its parliamentary majority, but that could be a gamble.
