US plans to make it harder for some people to get a green card

Tucson, Arizona – The first thing Alfredo* bought for his parents when he started working was a refrigerator. He was still in Mexico, in the city of Mazatlan in Sinaloa, where he worked in a little store.

But he wanted a better life, so he moved on with his wife and child. First to the state of Sonora, later crossing the border to Arizona in 1993 on a US visitor’s visa.

In Arizona, Alfredo washed dishes in a restaurant for a year, a job he got via another migrant he had met.

Eventually he found himself working as a handyman, plumber and landscaper throughout Tucson. 

From the moment he started working, Alfredo sent money back to his parents. The money was for improvements to the house he grew up in, which had no plumbing nor electricity.

All those years in Tucson, Alfredo paid taxes using an International Taxpayer Identification Number (ITIN). He wanted to follow the rules of the new country he was living in, which he also believed would eventually help him become a US citizen.

Now, 26 years later, Alfredo finally received his green card, giving him the opportunity to travel back to his home country and his family for the first time.

In five years, as the rules now dictate, he will also be able to become a US citizen.

But Alfredo considers himself lucky. He received his green card as the Trump administration announced a proposal that, if implemented, would have possibly blocked him from obtaining it, according to his immigration lawyer, Rachel Wilson. 

‘Only money matters’

Under the proposed rule, announced in September and officially published on Wednesday, immigration authorities could deny green cards, visas or even admission to immigrants who use or may use public assistance programmes, including food stamps, non-emergency Medicaid, housing vouchers and other types of federal assistance. 

Although immigrants must already prove they won’t be a “public charge”, the proposal details that the use or potential use of public assistance programmes may now work against their applications.

Alfredo and his wife did accept food stamps for their baby daughter 20 years ago.

“We got food stamps for her in the first years after she was born,” Alfredo told Al Jazeera, sitting in the office of his immigration lawyer. “Because we were just starting, this gave us that little extra to make ends meet.”

Because their daughter was a US citizen, they were eligible for food stamps as a household. The stamps were to buy eggs, milk and tortillas. As soon as Alfredo made enough money, she no longer went to collect the stamps.

Additionally, an individual’s English proficiency level may factor into the decision on his or her application.  For Alfredo, this may have proved difficult as his English is limited to his work as a handyman.

It remains unclear if past use of food stamps or limited English proficiency would be deemed a “public charge” under the proposal, which lawyers said is part of the problem.

“The difficulty with this new rule is that it’s all very vague,” Wilson told Al Jazeera.

“We don’t know for sure if those food stamps would be a problem, because the parents were only the ones picking them up. They were officially for the daughter. But their daughter was just born, so she couldn’t do that by herself,” Wilson said. 

“What they clearly don’t take into account in the new rule, is the 26 years of paying taxes. Under the new rule, these don’t count against the possibility that the applicant might have to make use of public assistance in the future.”

Advocates also fear the new proposal will adversely affect low-income individuals, as well as those with disabilities.

“This proposal says work and family don’t matter – only money matters,” the National Immigration Law Center said in a statement last month when the rule was first announced.

Center on Budget and Policy Priorities

Rights groups warn that immigrants may forgo desperately needed public assistance due to the fear of losing their eligibility for legal resident status.

The Center on Budget and Policy Priorities, a research institute promoting accessibility of the food-stamp programme, worries specifically for pregnant women and young children.

It said in a September statement: “Children may lose access to benefits that, in their later years, could mean better health, higher educational achievement, more work, and greater earnings.”

‘Abhorrent’ 

The public-charge rule dates back the Immigration Act of 1882, which included a clause that allowed for denial of entry to “any convict, lunatic, idiot or any person unable to take case of himself without become a public charge”. 

Immigrants had to prove they had at least $25 to be able to provide for themselves until they found a job.

Since then, its implementation has varied depending on the administration.

For example, the public-charge rule was enforced more strongly during the 1930s by President Herbert Hoover.

The current proposed rule would narrow the definition of public charge.

“This proposed rule will implement a law passed by Congress intended to promote immigrant self-sufficiency and protect finite resources by ensuring that they are not likely to become burdens on American taxpayers,” Homeland Security Secretary Kirstjen Nielsen said in a statement last month.

In the new rules, it’s also possible for the immigration services to demand a public-charge bond of $10,000 or more if they decide a migrant might become a public charge.

“That bond is another problem,” Wilson told Al Jazeera. “There is only a minimum amount given, no maximum. So the official might as well ask for an amount no one is able to pay unless they are very rich.”

Wilson said she doesn’t understand why the government tries to exclude a certain part of the migrant population.

“The people who clean your room in a fancy hotel are immigrants; they are part of the fabric of our society. We need that labour here. When we start saying, ‘we want people from this country and not from that country’ … well, you will start to find a lot of ugliness underneath that.”

DHS states that it receives seven million applications for permanent residency, immigration status and temporary work visa every year. 

Since 2001, roughly one million people obtain green cards yearly. According to Pew Research Institute, the majority already live in the US. 

USA Today reported that the proposed rule could affect more than 380,000 applicants each year. 

Wilson believes that more than 50 percent of her clients could be affected by the new rules and as a result, won’t be able to apply for a green card any more.

“I think this is an incredibly unfair policy. To use this public-charge rule to exclude people as if they are not part of this society is abhorrent,” Wilson said.

The official version of the proposed rule was published on the Federal Register on Wednesday. The public has until December 10 to make comments and suggestions on the rule. Changes will then be made the rule may be implemented. The rule changes are expected to go into effect at the beginning of next year. 

So close to the November midterm elections, many say the proposal seems to be a way for the Trump-administration to show how serious they are about closing the borders.

‘We’re not criminals’

Although Alfredo and his wife received their green cards, the couple still isn’t completely confident about their situation as of yet. They are now in their five-year probation period before they can become US citizens. 

Due to the ever uncertain changing immigration laws and regulations, Alfredo and his wife were advised by their lawyer not to use their real names when speaking to the media.

“That feels like something strange to do,” Alfredo said. “We are not criminals. We have nothing to hide; we just have no idea what will happen with this administration, and to us if we come forward with our names.”

Wilson nodded and said: “Them having to talk about this anonymously just goes to show what we have become in the United States. Immigration has always existed on earth. We go where there is work; we go where there is safety.”

Stephen Miller’s third grade teacher, Nikki Fiske, threw massive shade at the senior political adviser in an essay published by the Hollywood Reporter on Thursday. It’s probably best thing you’ll read today.

In the essay, Fiske described eight-year-old Miller  as a “loner” who “ate glue.” Yes, that’s right, glue. You know, that substance that should never be eaten, because it’s glue.

Here is the passage in which Miller’s glue eating tendencies were described: 

“He was a strange dude. I remember he would take a bottle of glue — we didn’t have glue sticks in those days — and he would pour the glue on his arm, let it dry, peel it off and then eat it.”

Yikes. 

Fiske also compared Miller to the Peanut’s character Pig Pen, who, as his name suggests, was filthy. Can you even fathom being so disliked that your third grade teacher wants to roast you on a national level?

Welp, looks like a former(?) glue eater is advising our president. This is fine.

Weatherman almost gets impaled by a 2×4 while covering Hurricane Michael

Mother Nature sent a clear message to this meteorologist: Get the fuck out of the way. 

The Weather Channel’s Jim Cantore, who’s known for venturing through the most perilous natural disasters, was nearly knocked out by a 2×4.

Cantore was recording a live report from Panama City Beach, Florida, when Hurricane Michael had just started to make landfall. While fighting heavy winds and torrential rain, an airborne plank flew past him. Cantore was able to duck out of the way, narrowly avoiding getting impaled on camera. 

It’s wild. 

His brush with death didn’t seem to faze the meteorologist. After jumping out of the way, he swapped out his hat to a batting helmet, and then immediate ran back out to continue his report. 

His helmet has a fan page now, too.

Breaking taboo, negative ads fly during Florida hurricane

It had once been considered taboo in Florida to run negative campaign attack ads as a hurricane batters the state.

But no more.

As Hurricane Michael bore down Wednesday on the Panhandle with Category 4 winds, the Republican Party of Florida broke with that tradition and continued to air two ads bashing Ron DeSantis’ Democratic rival in the race for governor, Tallahassee Mayor Andrew Gillum, over his city’s response to a hurricane in 2016.

And in the U.S. Senate race, the Democratic super PAC backing Sen. Bill Nelson (D-Fla) began running a negative commercial in strike-zone markets calling his opponent Gov. Rick Scott a dishonest “shady millionaire who doesn’t look out for you.” Also in those markets, a Republican super PAC supporting Scott is attacking Nelson in ad for being “an empty suit.”

There is a major difference between the two negative ads: The Senate campaigns have no say over the super PAC ads, can’t coordinate with the group under federal law, and Nelson’s campaign said no one should be posting negative ads in the counties affected by Michael. DeSantis’ campaign, however, is governed by state law and worked side-by-side with the state GOP with its attack ad.

“We can’t recall a time where candidates for statewide office have not pulled down negative ads during hurricane season,” Gillum said on MSNBC as the storm bore down. “You’ve got a whole region of our state, where folks are fleeing for their lives, anticipating what is a life-threatening event impacting this state. I again would encourage my opponent to just subside with the politics. We’ll have plenty enough room — beyond this storm — to compete between our ideas. What we need now is for the state to come together to reduce our partisanship and to focus on this important storm impacting our state.”

DeSantis’ campaign referred questions about the ad to the state Republican Party, which later said it would pull the ads down.

Hurricanes are one of the ultimate tests of a politician’s leadership skills in Florida and, if managed right, often help them on the campaign trail because of the free media they earn that shows them in charge and rising above politics. Still, campaigns and their backers typically have not attacked rivals in counties in media markets threatened or immediately damaged by hurricanes.

Striking as the most powerful hurricane to hit the Panhandle in a century, Michael’s eye made landfall Wednesday afternoon near Panama City, giving residents throughout the 35 counties with a disaster declaration hours of TV watching time before power began going out. In all, the storm affected five of Florida’s 10 media markets.

Scott, whose poll numbers rose after Hurricane Irma in 2017, has been particularly adept in leveraging his media appearances the day before Hurricane Michael approached, earning him more than 5,800 mentions on TV, 10 times that of Nelson or Gillum, according to the TVEyes tracking service. DeSantis had half of Gillum’s media mentions and fewer national broadcast hits on CNN, MSNBC and the Weather Channel — networks Scott has dominated.

Scott and Nelson have been neck and neck in recent public polls, but the Democrat has a small edge that’s well within their error margins.

Craig Fugate, a former Florida emergency manager under former Republican Govs. Jeb Bush and Charlie Crist and the former head of the Federal Emergency Management agency under President Barack Obama, issued a mild criticism of all the campaigning.

“I would encourage all Florida Candidates running for office to use this time to help raise funds for the @RedCross @SalArmyEDS @TeamRubicon and others part of the @NationalVOAD,” Fugate wrote on Twitter.

Trailing Gillum in most polls, DeSantis’ campaign has been the most negative of the four statewide campaigns.

The DeSantis campaign did complain that Gillum’s campaign is running a negative spot in the Jacksonville TV market — away from the hurricane — where Leon County’s sheriff said in the ad that DeSantis was “lying” about Gillum’s record concerning Tallahassee’s response to Hurricane Hermine in 2016.

In the Senate race, Chris Hayden, a spokesman for Senate Majority PAC that supports Democrats, said it’s not pulling its ad because the Scott-backing New Republican PAC continues to attack Nelson.

“We’re taking our lead on this from Scott’s super PAC,” Hayden said.

New Republican spokeswoman Melissa Stone said the PAC is working to pull the ad down.

“I don’t think anybody should be political advertising in an area affected by the storm that’s threatening people’s lives and property,” Nelson spokesman Dan McLaughlin said.

He said it was unfair the governor was still “airing all kinds of ads, including one about his leadership during hurricanes that’s airing on national TV.” McLaughlin said the commercial is inaccurate. Scott’s campaign stands by the ad.

Scott’s campaign pointed out that a positive Nelson ad had been airing in Tallahassee — firmly within the strike zone — but its bigger concern was the Senate Majority PAC ad.

“Governor Scott is the leader of the state of Florida. The people of Florida rely on him for accurate information about the path of the storm and federal, state and local efforts,” said his campaign spokesman Chris Hartline. “It’s offensive and, quite honestly dangerous, that Bill Nelson and his out of state allies would run their false, negative ads while Rick Scott is warning the millions of Floridians in the path of Hurricane Michael to evacuate or shelter in place. Now is not the time for politics.”

Troye Sivan Debuts Inspiring New Song ‘Revelation’ At Radio City Music Hall

Troye Sivan surprised lucky fans at Radio City Music Hall on Tuesday night (October 9) with the debut of his Boy Erased song “Revelation.”

The unreleased track, a hard-earned collaboration between Sivan and Sigur Rós’s Jónsi, is featured in Joel Edgerton’s forthcoming gay conversion therapy drama starring Lucas Hedges. The film follows a teen struggling to accept his sexual identity in a small Baptist community. Sivan also appears in the film in a supporting role, playing a young man who is enrolled in the same ex-gay program as Jared (Hedges).

After booking the role, the South Africa-born singer was eager to share his entire catalog with Edgerton in the hope that his songs would be featured in the film. In the end, two songs made the cut: Bloom‘s emotional breakup ballad “The Good Side” opens the film, while “Revelation” plays at a key moment of intimacy in Jared’s journey, when he realizes that “this person who he’s with is a revolution to him.”

Sivan called the experience of working on this film — and the process of writing an original song for it — “inspiring” before launching into the airy ballad, accompanied by a string quartet. “I don’t know if I’m allowed to sing it tonight. I hope it’s OK,” he joked.

“You’re a revelation / Won’t you liberate me now? / From my holy vow” he sings with raw honesty. “You’re a revolution / I will liberate you now / As the walls come down.”

The 23-year-old performer also opened up about his own coming-out journey to the sold-out crowd. During a moving performance of Blue Neighbourhood‘s “Heaven,” Sivan stood in front of a glowing venue, illuminated by cell phones lights and camera flashes. He sang the final chorus of the queer track in front of a rainbow light display as fans proudly waved their own pride flags — a striking image that made the emotional onstage proposal that happened moments before all the more heartwarming.

U.S. Air Force pilots spent a cloudy Oct. 9 morning crossing through the violent winds of Hurricane Michael. 

On their sixth pass, the pilots entered the storm’s eye during daylight, capturing footage of the 150-mph hour storm’s steep eyewalls. 

Hurricane Michael is making history Wednesday as the first Category 4 storm ever to hit the Florida Panhandle, and the second most powerful storm ever recorded this far north in the Gulf of Mexico.

“I love the job, but at the same time, hate that I had to go out to fly this today,” U.S. Air Force Reserve Pilot Will Simmons tweeted Wednesday morning.

A variety of U.S. Hurricane Hunting craft from the likes of the Air Force the National Oceanic and Atmospheric Administration (NOAA) have been making rocky trips through Michael over the last few days. 

While flying through, the planes release tubes called dropsondes that parachute through a storm’s wind, collecting vital information about the cyclone’s behavior.

Yesterday, storm forecasters expected Hurricane Michael to only grow stronger, as conditions in both the ocean and atmosphere would only lend more energy to the storm. 

They were right. 

As the National Weather Service ominously tweeted on Wednesday morning: “THIS IS A WORST CASE SCENARIO for the Florida Panhandle!!”

Cristiano Ronaldo’s Lawyer: Sexual Assault Documents ‘Altered’ or ‘Fabricated’

An attorney for Juventus superstar Cristiano Ronaldo released a statement Wednesday claiming documents related to the sexual assault allegation made against his client featured “significant parts” that were either “altered and/or completely fabricated.”

The Independent’Samuel Lovett provided comments from lawyer Peter Christiansen about the documents, which were originally published by German outlet Der Spiegel, related to a lawsuit filed by Kathryn Mayorga, who alleges Ronaldo raped her in a Las Vegas hotel room in 2009:

“Cristiano Ronaldo vehemently denies all the accusations in this civil action, in consistency with what he has done in the last 9 years. The documents that allegedly contain statements by Mr. Ronaldo and were reproduced in the media are pure inventions. By 2015, dozens of entities (including law firms) in different parts of Europe were attacked and their electronic data stolen by a cyber criminal.

“This hacker tried to sell such information, and a media outlet irresponsibly ended up publishing some of the stolen documents, significant parts of which were altered and/or completely fabricated. Once again, for the avoidance of doubt, Cristiano Ronaldo’s position has always been, and continues to be, that what happened in 2009 in Las Vegas was completely consensual.”

Last week, TMZ Sports reported information from Mayorga’s lawsuit, which alleged Ronaldo sodomized her despite her repeated attempts to stop him and requests to leave the room.

The Las Vegas Metropolitan Police Department reopened its investigation based on the latest details, but the Portugal international released a statement denying the claims, per TMZ:

“I firmly deny the accusations being issued against me,” Ronaldo said. “Rape is an abominable crime that goes against everything that I am and believe in. Keen as I may be to clear my name, I refuse to feed the media spectacle created by people seeking to promote themselves at my expense.

“My clear conscious will thereby allow me to await with tranquility the results of any and all investigations.”

Christiansen said in his statement Wednesday the player did reach an out-of-court settlement with Mayorga in 2010, but it did not include an admission of guilt, according to Lovett.

“Cristiano Ronaldo does not deny that he agreed to enter into an agreement, but the reasons that led him to do so are at least to be distorted,” he said. “This agreement is by no means a confession of guilt. What happened was simply that Cristiano Ronaldo merely followed the advice of his advisors in order to put an end to the outrageous accusations made against him.”

TMZ reported Mayorga’s lawsuit includes an attempt to void the $375,000 deal, which included a nondisclosure agreement.

Hurricane Michael makes landfall as ‘monstrous’ Category-4 storm

Hurricane Michael made landfall on Florida’s Panhandle as a “monstrous” Category-4 storm on Wednesday, bringing with it life-threatening winds, catastrophic storm surges and rainfall. 

The National Hurricane Center (NHC) said the hurricane was intensifying as it pounded the coast just outside Mexico Beach, Florida. 

With maximum sustained winds of 250km/h, it is one of the most intense hurricanes to ever hit the US mainland, and the most powerful one on record to menace the Panhandle, a roughly 200-mile stretch of fishing towns, military bases and holiday beaches. 

Its winds roaring, Michael battered the coastline with sideways-blown rain and crashing waves, swamped streets, bent trees, stripped away leaves and limbs and sent building debris flying.

Explosions apparently caused by transformers could be heard. Michael’s menace was compounded by its relatively quick development, growing from a tropical storm to Category-4 hurricane in about 40 hours.

Rainfall could reach up to a 30cm, and the life-threatening storm surge could swell to four metres. The storm appeared to be so powerful it is expected to remain a hurricane as it moves over Georgia early Thursday. 

“We are in new territory,” National Hurricane Center Meteorologist Dennis Feltgen wrote on Facebook. “The historical record, going back to 1851, finds no Category-4 hurricane ever hitting the Florida Panhandle.”

Too late to evacuate

More than 2.1 million residents of at least 20 Florida counties were under mandatory or voluntary evacuation orders.

Earlier on Wednesday, Florida Governor Rick Scott said on Twitter that it was too late to evacuate the target zone and that people who had stayed should immediately seek refuge.

Some of the storm’s most significant early impact was to offshore energy production. US producers in the Gulf cut oil production by about 40 percent and natural gas output by 28 percent on Tuesday, the Bureau of Safety and Environmental Enforcement said.

President Donald Trump declared a state of emergency for the entire state of Florida, freeing up federal assistance to supplement state and local disaster responses.

NHC Director Ken Graham said Michael represented a “textbook case” of a hurricane system growing stronger as it drew near shore, in contrast to Hurricane Florence, which struck North Carolina last month after weakening in a slow, halting approach.

He said the storm would still have hurricane-force winds as it pushed through Florida into Georgia and tropical storm-force winds when it reaches North and South Carolinas, which are still reeling from post-Florence flooding.

The region should brace for “major infrastructure damage”, specifically to electricity distribution, wastewater treatment systems and transportation networks, Jeff Byard, associate administrator for FEMA, told reporters on a conference call.

Residents fear they’ll lose everything

Many state offices, schools and universities in the area have been closed since Tuesday.

Among those who fled their homes was Betty Early, 75, a retiree who joined about 300 fellow evacuees huddled on makeshift bed rolls of blankets and collapsed cardboard boxes at an elementary school serving as an American Red Cross shelter in Panama City, near the storm’s expected landfall.

She was unsure how well her old, wood-framed apartment block would hold up. “I’m blessed to have a place to come,” she told Reuters news agency.

“My greatest concern is not having electricity, and living on a fixed income, losing my food.”

In the town of St Marks, John Hargan and his family gathered up their pets and moved to a raised building constructed to withstand a Category-5 after water from the St Marks River began surrounding their home.

Hargan’s 11-year-old son, Jayden, carried one of the family’s dogs in a laundry basket in one arm and held a skateboard in the other as he waded through calf-high water.

Hargan, a bartender at a riverfront restaurant, feared he would lose his home and his job to the storm.

“We basically just walked away from everything and said goodbye to it,” he told the Associated Press, tears welling up. “I’m freakin’ scared I’m going to lose everything I own.”

About 2,500 National Guard troops were deployed to assist with evacuations and storm preparations, and more than 4,000 others were on standby. Some 17,000 utility restoration workers were also on call.

Meanwhile, neighbouring states were also making preparations 

Georgia Governor Nathan Deal declared a state of emergency on Tuesday for 92 counties in his state.
